What is it about?

Geographical Indication (GI) claims turn on TRIPS Art. 22(1) criteria. This article concludes quality and characteristics elements of the EU 'Prosecco' GI claim are not 'essentially attributable' to the relevant location by analysis of objective criteria and explains why this is so.

Why is it important?

GI claims are increasingly contentious. Given the significance of trade barriers which can arise from unjustified GI claims, it is increasingly important to test them against objective evidence.

Perspectives

The article argues that the legitimacy of all GI claims should be tested against objective evidence. The approach of examining product specifications for consistent qualities and characteristics which may be attributable to location, especially in light of other evidence concerning impact of locality attributes upon quality is one which can be transposed to test any GI claim.
