What is it about?
Mortgages Transactions or mortgages from inception have witnessed various developments and innovations. This has been largely influenced by the various statutes and laws in place. However, with the advent of the Land Use Decree 1978, (hereinafter simply the Act) Mortgage transactions have been tainted with issues and the various legislative lacunae have been spotted and exploited by mortgagors especially where they are unable to fulfil their obligations under the mortgage agreement. We believe that an examination in the course of our paper of, amongst others, the history, origin, nature of interest involved, characteristics, enforcement procedures and its general mode of operations within the ambit of the Act would reveal its efficacy or illusion in Nigeria.
