What is it about?
Direito e Religião sempre estiveram muito próximos, e hoje em dia esta realidade não é diferente. Assim, o presente artigo pretende discutir o crescente avanço das ditas "Bancadas Evangélicas" que com isso vem provocando a rediscussão de grandes temas da sociedade, alcançando outro patamar de debate no meio político. Cercada de dogmas e paradigmas, a religião e a religiosidade fazem parte da sociedade desde a Era Primitiva, de forma que os seres humanos manifestam a sua espiritualidade de diversas maneiras ao longo do tempo. Por outro lado, as casas legislativas têm recebido um número crescente de parlamentares de confissão religiosa pública, o que tem trazido à tona um debate muito antigo: se deveriam os religiosos participar da carreira política; se é compatível o exercício do cargo religioso e do cargo político e se é saudável para a democracia a participação de uma "bancada religiosa" nas casas legislativas. O presente artigo pretende ainda trazer estas e outras discussões, começando pela origem do Direito, a interferência da Religião no seu desenvolvimento, o papel da mesma para o desenvolvimento da sociedade, dos direitos e a laicidade do Estado em face da necessidade de regulação de matérias religiosas, bem como discute o papel da Liberdade Religiosa face ao direito das minorias manifestarem a sua liberdade de consciência e crença, como preconiza a Constituição brasileira. ----------------. Law and Religion have always been very close, and today this reality is no different. Thus, this article discusses the growing advancement of said "Tops Evangelical" that it has led to renewed discussion of major topics of society, reaching another level of debate in the political arena. Surrounded by dogmas and paradigms, religion and religiosity are part of society since it was early, so that human beings express their spirituality in different ways over time. On the other hand, the legislative houses have received an increasing number of parliamentary public religious confession, which has brought to light a very old debate: whether to participate in the religious political career; it supports the exercise of religious office and political office and is healthy for democracy the participation of a "religious counter" in the legislative houses. This article intends to bring these and other discussions, starting with the origin of law, the interference of religion in its development, the role of the same for the development of society, the rights and the secular nature of the State in view of the need for regulation of materials religious, and discusses the role of religious freedom against the rights of minorities express their freedom of conscience and belief, as recommended by the Brazilian Constitution.
