What is it about?

The article discusses whether Israel had a right to invoke self-defence in response to the attack of 7 October 2023 and goes on to examine whether its exercise of self-defence continued to meet the requirements for lawful self-defence in the period following the attack until the article was submitted for publication in May 2024.

Why is it important?

While the debate on whether Israel had and continues to have the right to exercise self-defence is but one piece in a larger whole, it remains relevant for understanding what the limits of self-defence are and how this relates to the ongoing conflict in Gaza.

Perspectives

Self-defence is an important concept in international law as it is the only accepted legal basis for the use of transboundary force absent a UN Security Council mandate to do so. Understanding its place within international law and its scope and limitations is therefore crucial to understanding whether a particular use of force is legitimate or not.
