Why is it important?

This is the first case on the right to remain after divorce as a victim of domestic violence in Art. 13 of Directive 2004/38/EC.

Perspectives

The CJ EU's ruling does not preserve the effet utile of the right to remain after divorce of victims of domestic violence, but rather seeks to find other ways to ensure future residence in the host-Member State.
