What is it about?

The existence of a dispute affects whether or not an international court can have jurisdiction over a case. While the emergence of disputes has been discussed in detail in the literature, the ways in which disputes are extinguished (ended) remains underexplored. This article analyses disputes in international law are definitively and finally resolved. It argues that the extinction of a dispute is a distinct legal process which changes the legal situation of the parties. It further argues that this legal process in rooted in the international judicial function.
