What is it about?

This paper considers the geography and history of the two natural waterways, linked by the Sea of Marmara – the Bosporus strait (Istanbul Strait) to the north-east, and the Dardanelles (Çanakkale Strait) to the south-west. Then it addresses certain aspects of the 1936 Convention regarding the Regime of the Straits (known as the Montreux Convention); what constitutes a merchant vessel and a vessel of war, the regulation of peacetime transit of vessels of war, and the regulation of their transit during times of war. Also, some of the classical questions in relation to the Montreux Convention are addressed in the context of the Russo-Ukrainian armed conflict, as whether Turkey may close the Straits to Russian vessels of war, and whether the transportation by Russian owned or flagged merchant vessels of military equipment from Syria to Russian(-held) ports in the Black Sea is in violation of the Montreux. The paper will then consider the regulation of amendment and denouncement of the Montreux Convention, before it looks ahead at the future.
