What is it about?

Law & Economics and Comparative Law are often said to be the most relevant approaches to the law developed during the 20th century. However, they are rarely combined. Inspired by the expression ‘the map is not the territory’, this paper proposes a path to bring them together.

Why is it important?

This paper shows that Law & Economics can play a central role in providing a more rational methodological foundation for much of the research undertaken in Comparative Law. If the researcher is aware of its limitations, Law & Economics is well suited to providing analytical and normative frameworks that increase our ability to compare and evaluate real-life legal institutions by reducing the complexity of the law in action.
