What is it about?

What are the obligations of foreign investors with respect to human rights and the environment? How can these human right and environmental obligations be effectively implemented in pratice through international investment agreements? The article explores the utility of corporate social responsibility (CSR) clauses in inter- national investment agreements and provides an empirical overview of the content of such CSR clauses. It proposes to design new and clearer clauses on ‘investor human rights and environmental obligations’ based on the Guidelines for Multinational Enterprises and the United Nations Guiding Principles on Business and Human Rights and that allow access to remedy for affected individual of investment schemes.
