What is it about?

Examining the practice of ex gratia claims this work argues that a change in approach is needed. Whereas these ex gratia payments are often represented as efforts of winning hearts and minds and adressing harm, the fact that they exclude subsequent claims makes this paper critical of this claim. As an alternative, this paper suggest adopting an approach which is currently visible within human rights law and judge ex gratia claims in a more substantial matter.
