What is it about?

National procedural laws are used as templates for the procedural rules of international tribunals although it is obvious that prosecuting crimes against humanity is very different from prosecuting regular crimes. The consequences of these differences are discussed in the article when it comes to issues of e.g. legitimacy, independent and impartial tribunals and the presumption of innocence, all highlighted against the justice first principle as formulated by M. Cherif Bassiouni.
