What is it about?
This work discusses whether preventing forcibly displaced persons from returning to the territory from which they were expelled can be punished as an international crime. With growing and unprecedent levels of forced displacement affecting millions across the world, this issue is both topical and significant. The article addresses a significant gap that exists in international law and academic scholarship and argues that criminalisation of such denial of return is a necessary response to effectively address and prevent forced displacement.
