What is it about?
As a matter of principle, courts expect witnesses and experts to provide testimony live in open court. However, within the field of International Criminal Justice, a practice has emerged allowing the presentation of testimonial summaries. Where experts are involved this may negatively impact on the fairness of the trial process. This paper analyses a recent example of this practice, and makes recommendations.
