What is it about?

This article offers a fresh look at the law of state succession, a highly important but contested area of international law. It argues that two problematic concepts at the heart of this area of international law are the source of many of the problems that exist in this area. As a result, it argues that a functional reframing of these concepts could provide a path forward.
