What is it about?
The patient's informed consent has been inconsistently defined as a right, an immunity and even a power of the patient, leaving its conceptualisation as partially unclear. Furthermore, its complex two-fold structure has been widely neglected, hindering its application in both the legal practice and the supply of healthcare services. The present paper provides the patient's informed consent with a steady legal structure, answering any possible doubt on the subjective legal positions of the parties involved in the medical relationship.
