What is it about?
The textual expression of an agreement may provide an extra-contractual opt out when the costs of compliance are less than its benefits. This is manifest through discretion embodied in the use of standards rather than rules in specifying commitments. Thus disputes and use of intra-contractual opt outs, such as safeguards, are avoided.
