The paper summarises and critically assesses the legislative response in banking and securities regulation to the determinants of the global financial crisis. It draws upon the United Kingdom, the United States, the European Union, and international approaches.

Why is it important?

The paper provides a review of the crisis from a broad perspective. It attempts to understand and convey how countries and governments are responding, at an early stage after the event.

Perspectives

This is the author's earliest paper on the legal responses to the crisis, written in the summer of 2012 and published in the JFC in 2013. The early publication in the United States of the Dodd-Frank Act seemed to be a decisive response to the event, whilst action from within Europe seemed to be a little more measured. The article investigates these issues.
