Management of gross negligence manslaughter liability construction for professionals and lessons learned

What is it about?

This study considers that in the core concept of GNM in the Criminal Code of Taiwan, “business” is an outstretched legal element, thus it shall be prohibited to use “application by analogy” and “customary laws” as the legal basis or when applying. This study agrees with the removal of GNM titled “business” in the Criminal Code of Taiwan to achieve the sustainable development goal of a fair, just, and reasonable judicial system for the construction industry.
